Effective Date: November 21, 2025

These OAVC Developer Supplemental Terms supplement and form part of the OAVC Game Studio Terms of Service and apply to all users who access Unreal Engine Editor tools or other creation features to modify, create, or contribute content to the game (“Developers”). By using these tools, you agree to these Supplemental Terms in addition to the main Terms of Service.

1.  Eligibility to Use Developer Tools

To access Unreal Engine Editor tools or any other creation features (“Developer Tools”), you must be at least 18 years of age. Users aged 13 to 17 may only use Developer Tools with the consent of a parent or legal guardian who has read and agreed to these Developer Supplemental Terms and the main OAVC Game Studio Terms of Service. Users under 13 are not permitted to use Developer Tools in the public OAVC Game Studio Services. Children under 13 may only participate in creation activities through The Foundation’s separate nonprofit program under its own terms and verifiable parental consent process. In addition, you must have:

  • an active paid subscription tier that includes Developer Tools access, or
  • a verified Volunteer Account issued under a separate Volunteer Agreement, or
  • a Foundation account (for participants in The Foundation’s separate nonprofit program)

2.  Definition of Developer

A “Developer” is any user who meets the eligibility requirements above and accesses Unreal Engine Editor tools or other creation features to develop or contribute content to the game, including beta testers and volunteers gaining real-world game development experience.

3.  Developer-Made Content Using OAVC IP

If your content incorporates any OAVC-provided assets, code, templates, reference materials, trademarks, or other intellectual property (“OAVC IP”), the resulting work is Developer-Made Content and a derivative work. All copyright and other intellectual property rights in that Developer-Made Content are automatically assigned to OAVC upon creation. You retain no ownership or commercial rights in any Developer-Made Content.

4.  License Grant for All Developer Content

By creating, uploading, or otherwise making available any content using Developer Tools (whether or not it contains OAVC IP), you grant OAVC an irrevocable, perpetual, royalty-free, worldwide, fully-paid license to use, copy, modify, distribute, display, perform, and create derivative works of such content for any purpose, including commercial use, without further payment or approval.

Obligations and Restrictions As a Developer, you agree to:

  • Use OAVC IP and Developer Tools only for non-commercial purposes within the Services unless expressly authorized in writing.
  • Not reverse-engineer, decompile, or extract source code from the game or tools.
  • Sign and abide by the Non-Disclosure Agreement (NDA) for reference materials (attached as Exhibit A).
  • Ensure all content is original and does not infringe third-party rights.
  • Comply with the OAVC Terms of Service, Community Standards, and all applicable laws.

OAVC may moderate, remove, or reject any Developer-Made Content at its sole discretion.

5.  No Revenue Share (Current)

There is currently no revenue share for Developer-Made Content. OAVC may introduce programs in the future.

6.  Governing Law

These Developer Supplemental Terms are governed by Arizona law and subject to the dispute resolution provisions in the main OAVC Game Studio Terms of Service.

Exhibit A – Non-Disclosure Agreement (Reference Materials) Developers agree not to disclose, copy, or use OAVC reference materials outside the authorized development or Enriched Play™ program without prior written approval. Breach may result in termination of access and legal action.
